2. Basis of the Course Enrolment Contract:

2.1 The submitted enrolment form constitutes a request by you to attend the course or custom tutoring in accordance with the below terms and conditions. By submitting the enrolment form you confirm that you are over 18 years of age. For any student below 18 years wishing to enrol in any eligible short course, a parent or guardian should submit the form on behalf of the student.

2.2 Receipt of the enrolment form does not constitute an acceptance of your request. Your enrolment shall only be deemed accepted upon receiving full payment of the course or tutoring contract through an email of confirmation sent by us.

2.3 This contract constitutes the entire agreement between both parties, where you acknowledge that you have not relied on any statement, promise, representation, assurance or warranty made or given by us or on our behalf which is not set out in the enrolment contract.

2.4 Any descriptive matter or advertising issued by us, and any descriptions contained in our short courses are issued or published for the sole purpose of giving an approximate idea of the course syllabus coverage. Save as expressly stated in this contract, they shall not form part of the contract or have any contractual force.

2.5 The sole terms and conditions of Hyphen Institute apply to the contract to the exclusion of any other terms that you seek to impose or incorporate, or which are implied by trade, custom, practice or course of dealing.

3. Payment – Short Course, Custom Tutoring or Business Services:

3.1 At any time prior to the commencement of the course you may give notice in writing to us that you no longer wish to attend the course subject to paragraph 3.2 below.

3.2 If you give notice to us pursuant to paragraph 3.1 you shall be released from all your obligations under this contract except that if you give notice to us we will be entitled to a cancellation fee and will only be obliged to refund to you the amount, as set out below:

a) for cancellations made by you 16 days or more before the course start date, the refund shall be 80% of the total fee.

b) for cancellations made by you 15 days or less before the course start date, the refund shall be 50% of the total fee; and

c) for cancellations made after the start of the course – no refund of the total fee will be issued.

4. Termination of Contract for Company/Individual for our Business Service Offerings:

4.1 Without prejudice to any other rights or remedies which we may have, where you are a company, we may terminate this contract without liability to you on giving written notice:

a) for any reason upon not less than 90 days’ notice; or
b) where you become (or, in our reasonable opinion, are at serious risk of becoming) insolvent or unable to pay your debts as they fall due.

5. General Obligations during a Short Course, Custom Tutoring or Business Services:

5.1 You agree to pay the fee and/or any other payment amounts notified in the enrollment form/letter before the course starts.

5.2 Course / training times are in the current Sri Lanka Time (GMT+5:30)

5.3 During the specific duration of the course Hyphen Institute will deliver it in accordance with the relevant syllabus content and appropriate course material with quality and skill.

5.4 You will need to use the course material for the duration of the course and for the purposes of the course deliverables or as otherwise specified by us,

5.5 Students partaking to a short course/ customised tutoring, where applicable, should meet any language prerequisites and qualifications requirements, as set out in the course content.

5.6 You must ensure access to a computer/mobile device with video conference capability, sound and a reliable internet connection for the duration of the class/ training session.

5.7 Hyphen Institute cannot accept responsibility for a missed session caused by computer equipment/ internet connection inadequacy or any other failure.

5.8 If a student/ corporate individual breaches the obligations, Hyphen Institute reserves the right to terminate course enrollment/ contract by serving written notice.

a) Any unpaid fee by the date of termination becomes payable.

6. Course content & material:

6.1 We reserve the right to alter details of any course content if this is required to reflect advances in the field, changes in the law or regulatory requirements.

6.2 Hyphen Institute reserves the right to change the teaching/ training delivery platform.

6.3 In circumstances where the designated tutor / trainer for your course is not available due to unforeseen circumstances, we will endeavor to provide an equivalent substitute or in the event of no such substitute is available, the course will be postponed to a later date on the same schedule. If that solution cannot be accommodated, cancellation of the course and a refund of the fees for that course session will be provided.

6.4 You have no rights to copy (in whole or in part) or disseminate any teaching material other than for your personal use as part of the course.

7. Accreditation of the course:

7.1 Unless expressly stated in the course content, the course is not formally accredited.

7.2 Where a course is stated to be accredited by a third-party provider in the course content, the third-party provider’s terms and conditions will apply and our obligations will be limited to providing the course. We will have no influence over their accreditation process, are not responsible for providing the accreditation and we do not accept any responsibility for any services relating to the course that is not expressly mentioned as being provided by us in the course content.
